Summary
In November 2021, three students at Clovis Community College obtained approval to post anti-communist posters insider campus buildings. After receiving complaints that the posters made students feel uncomfortable, the President of Clovis had the posters taken down. Later, the same students asked to hang posters advocating pro-life views. The school would not let them hang the posters on the school bulletin board, but instead required they be hung on a small box far away from the school. Clovis defended its decision, citing its poster policy, which prohibits flyers with “inappropriate or offense language or themes.”
The students brought suit in federal court in August 2022 against the school, alleging that the poster policy is an unconstitutional prior restraint on student speech that discriminates based on viewpoint.
