Summary
On April 23, 2026, Defending Education, a nonprofit conservative parents’ rights group focused on education policy and litigation, filed a federal lawsuit against Missouri State University challenging its Bias Response Team and related policies under the First Amendment. The university’s Bias Response Team was designed to receive reports of alleged bias incidents involving members of the campus community and review concerns involving speech or conduct that individuals believed reflected bias. The complaint alleged that the team’s broad definition of “bias incidents,” anonymous reporting options, and review procedures allowed the university to investigate protected expression and created a chilling effect on student speech. The plaintiff asserted that the policy constituted viewpoint discrimination.
The complaint further alleged that the Bias Response Team could review reports even when the reported conduct did not constitute a violation of university policy or unlawful harassment. According to the lawsuit, the possibility of being reported, investigated, or referred to other university offices could deter students from expressing controversial or unpopular viewpoints. The complaint argued that the university’s response system gave officials discretion to address speech based on its perceived viewpoint or impact rather than whether it constituted unprotected conduct. The lawsuit sought declaratory and injunctive relief to prevent enforcement of the policy and similar practices.
On April 23, 2026, Missouri State University announced that it had eliminated its Bias Response Team following the filing of the lawsuit. University officials stated that the decision was part of a review of the program and its policies. The university later stated that it had decided in March 2026 to discontinue the team, with the change scheduled to take effect July 1, 2026, and that the decision was not made in response to the lawsuit. Defending Education disputed that characterization, arguing that the university’s decision followed the filing of the litigation.
On June 16, 2026, the parties announced a settlement resolving the lawsuit. Under the agreement, Missouri State University permanently removed the Bias Response Team and its related reporting system and agreed not to reinstate the program or establish a similar bias response system unless required by law or regulation.
