Summary
Tim Bakken, a civilian law professor at the U.S. Military Academy at West Point, filed a federal lawsuit on September 22, 2025, alleging that the academy’s policies violated his First Amendment rights and academic freedom. The lawsuit sought class action status on behalf of over 100 civilian faculty members and named West Point and its leadership as defendants. Bakken’s complaint focused on the “Academic Engagement Policy” implemented in February 2025, which required faculty to obtain prior approval before engaging in public speaking or publishing. He stated that he had a contract with a publisher for a book critical of aspects of West Point and was reluctant to seek approval due to concerns that it could be withheld.
The complaint alleged that these restrictions were part of a broader effort to limit faculty speech and academic freedom following a January executive order from President Donald Trump directing a review of service academies’ curricula and leadership. Bakken requested a court order to block enforcement of the policy and sought unspecified damages and legal fees.
The lawsuit was filed amid wider changes in military institutions, including directives affecting Department of Defense media policies and the removal of certain books from academy libraries. Reports indicated that the Pentagon had also adjusted diversity, equity, and inclusion initiatives, including banning certain observances and changing admissions practices.
